Five steps to an elected works council

A works council is mandatory when your company has on average 20 or more employees (Labour Code, Art. 169(1)). The whole process takes about 4 weeks. The Linden system prepares every document and reminds you of every deadline.

  2. Set up the election committee

    The Linden system prepares the director's order. The committee has 3–7 members, and managers make up no more than one third. Committee members cannot stand as candidates. You sign the order.

    The committee is set up within 2 weeks of the duty to form a works council arising (Art. 171(2)).

  3. First committee meeting

    The Linden system prepares the meeting minutes: committee chair, election day, deadline for nominations and the number of seats.

    The election takes place no later than 2 months after the committee is set up (Art. 171(3)).

  4. Nominations

    Each employee with a vote may nominate one candidate, and the candidate agrees in writing. The Linden system collects the nominations and builds the final list of candidates.

    The list is published at least 14 days before the vote. If there are too few candidates, the committee sets extra time. If there are still too few, the election fails, and the Linden system reminds you of the new election 6 months later (Art. 171(5)).

  5. Vote

    The Linden system prepares the voter list, the ballots and the ballot issue register. Employees with at least 3 months of service vote. The vote happens during working time, paid at average pay (Art. 171(1) and (6)).

    If half of the employees or fewer vote, a repeat vote is held within 7 days. The repeat vote is valid if at least one quarter vote (Art. 171(10)).

  6. Results and the first council meeting

    The Linden system prepares the results record and notice, the invitation to the first council meeting, its minutes, and the council chair's notice to the State Labour Inspectorate.

    The first meeting takes place no earlier than 5 and no later than 10 days after the results are announced. The council chair notifies the Inspectorate within 1 month of the council taking office (Art. 173(1) and (6)).

    The elected council can take part in the consultation on your pay system.
